MOH Licensing Under the Private Healthcare Facilities and Services Act 1998
All private care facilities listed on our platform operate under valid licences issued by the Ministry of Health Malaysia (MOH) under the Private Healthcare Facilities and Services Act 1998 (Act 586) and its subsidiary regulations. Nursing homes are classified as Private Care Centres and require a separate operating licence distinct from that issued to private hospitals.
Licensing requirements include: minimum staff qualifications and ratios; specified physical standards for room dimensions, bathroom facilities, fire exits, and emergency equipment; documented admission and discharge procedures; a complaints and grievances mechanism; and mandatory infection control protocols. Licences must be renewed annually following a satisfactory inspection by MOH healthcare premises inspectors. Families can verify a facility's licensing status by contacting the relevant State Health Department or through MOH's online licence verification portal.
JKM Registration Under the Care Centres Act 1993
Some care homes — particularly those providing primarily social rather than medical care — are registered with Jabatan Kebajikan Masyarakat (JKM) under the Care Centres Act 1993 (Act 506) rather than, or in addition to, MOH licensing. JKM-registered care centres include day care centres, residential care homes for the elderly, and facilities for persons with disabilities.
JKM registration requires: background checks for management personnel; adequate staffing levels; fire safety certificates from Bomba (Fire and Rescue Department); food handling certificates for kitchen staff; and documented activity and welfare programmes. JKM conducts unannounced inspections. Facilities with a JKM certificate of registration must display it prominently on their premises. Families can contact any JKM district office to verify a facility's registration and check for any compliance notices.
Ongoing Compliance Monitoring
Regulatory compliance is a continuous operational commitment, not a one-time event. Our listed facilities are expected to:
- Maintain current MOH and/or JKM registration at all times and notify us immediately if a licence is suspended or revoked
- Submit to annual third-party facility audits as a condition of our directory listing
- Report any serious adverse incidents (falls resulting in fracture, unexplained deaths, fire incidents, abuse allegations) to MOH and to our platform within 24 hours
- Maintain an up-to-date complaints register and provide copies to residents and families on request
- Display the facility's licence number, registration number, and most recent inspection outcome in a visible location within the facility
We reserve the right to remove any facility from our directory whose licensing status lapses or whose compliance record falls below acceptable standards.
